Terms of Use

1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and HexnHue ("Company," "we," "our," or "us") regarding your use of the Stretcho mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Acknowledgement

You acknowledge that these Terms are between you and HexnHue only, and not with Apple Inc. ("Apple"). HexnHue, not Apple, is solely responsible for the App and its content. These Terms do not provide usage rules that conflict with the Apple Media Services Terms and Conditions.

3. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple-branded devices that you own or control, as permitted by the Apple App Store Terms of Service.

You may not:

  • Distribute or make the App available over a network where it could be used by multiple devices at the same time.
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App.
  • Copy, modify, or create derivative works of the App.
  • Remove, alter, or obscure any proprietary notices in the App.

4. Subscriptions & Payments

a) Subscription Plans

Stretcho offers auto-renewable subscription plans that unlock premium features. Subscription details (pricing, duration, and features) are displayed within the App at the time of purchase.

b) Billing

  • Payment is charged to your Apple ID account at the time of purchase confirmation.
  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the same subscription rate.

c) Managing & Cancelling

You can manage and cancel your subscription at any time through your Apple ID account settings or the App Store. Cancellation takes effect at the end of the current billing period — you will continue to have access until then.

d) Refunds

All purchases are processed by Apple. Refund requests must be directed to Apple per their refund policy.

5. Health & Wellness Disclaimer

The App provides general stretching guidance and wellness suggestions. It is not a medical device, and the content is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

  • Always consult a qualified healthcare provider before beginning any new exercise or stretching program.
  • Stop any exercise immediately if you experience pain, dizziness, or discomfort.
  • We are not liable for any injury resulting from following stretch routines provided by the App.

6. User Conduct

You agree not to:

  • Use the App for any unlawful purpose.
  • Attempt to interfere with or disrupt the App's functionality or infrastructure.
  • Use automated means to access the App (bots, scrapers, etc.).
  • Circumvent any access restrictions or usage limits.

7. Intellectual Property

All content in the App — including but not limited to text, graphics, illustrations, animations, logos, and software — is the property of HexnHue and is protected by copyright and intellectual property laws. You may not use any content from the App without our prior written consent.

8. Maintenance & Support

HexnHue is solely responsible for providing maintenance and support services for the App. Apple has no obligation to provide any maintenance or support services for the App. For support, contact us at codingmunk94@gmail.com.

9. Warranty Disclaimer

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. HexnHue, not Apple, is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.

In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.

10. Limitation of Liability

To the maximum extent permitted by law, HexnHue shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, personal injury, or property damage.

HexnHue, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.

11. Third-Party Terms

You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement). You agree not to use the App in violation of any such third-party terms.

12. Intellectual Property Claims

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, HexnHue, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

13. Apple as Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

14. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Upon termination, your license to use the App will immediately cease. Sections regarding intellectual property, disclaimer of warranties, limitation of liability, and Apple as third-party beneficiary shall survive termination.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the App after any changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
